Governing Law and Dispute Resolution
1. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
2. Consumer Protection
If you are a resident of Saskatchewan or Alberta, the mandatory consumer protection laws of your province of residence continue to apply to your membership and services, to the extent those laws provide you with greater protection or rights that cannot be waived by contract.
3. Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of our Services shall be brought exclusively in the courts located in Ontario, Canada, except where prohibited by mandatory consumer protection laws in your province of residence that require disputes to be resolved in your home jurisdiction.
4. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable consumer protection legislation in your province, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
